Not a lot of dogs need 38% Protein.
Most hard working dogs need at least 18% (prefer 20%) Fat.

I feed 28/18 Spring and Summer and go to the 30/20 during the colder months of hunting seasons.

I would agree. 38% seems like a lot of protein. Had a vet tell me once that too much protein may not be good for dogs. I have had the best luck with, and prefer, protein of approx. 26% for normal feeding and when the dogs aren't working real hard. Hunting season and trials I might go to 30% but even then I tend to feed the 26%. Dogs do great.

As long as a dog has normal kidneys and is otherwise healthy, up to 49+% isn't harmful.

But isn't feeding an excessive amount of protein putting a lot of unnecessary stress on the kidneys? Even for a healthy dog with "normal kidneys"? Why feed more protein than the dog needs???

Studies in racing dogs have shown protein higher than 35% was detrimental to performance. Wish I had a copy to show you, but its in my long gone didn't know I'd need it canine nutrition notes. Its just a pearl I remember...

Protein is more expensive than fat and carbohydrates. Why pay more for something they don't need?

Kiwi colleague , I suspect the answer to your question is similar to why so many duck hunters shoot 3.5" shells and why there are 3,000,000 different types of bass lure  .

Excess protein isn't likely to harm a dog but somewhere around 30% any benefit from adding more is lost.
